Privacy Policy

This Privacy Policy (the “Privacy Policy”) explains how the software Platform entitled “Propeller” (“Platform”) that was created by Propeller CRM Inc., (“Propeller”) collects, stores, uses, and discloses information from you when you use the Platform. If you do not agree with or are not willing to comply with any portion of this Privacy Policy, do not download or use the Platform.

REGISTRATION INFORMATION
When you register and download the Platform, Propeller will collect your email address (which may contain your name), password, the date and time at which you registered to use the Platform and accepted the Propeller Terms of Service and this Privacy Policy, and your Third Party Account Authorization (as defined below)account information (collectively, your “Registration Information”). Propeller may use your Registration information to contact you from time to time with information regarding the Platform or Propeller’s services, including sending email messages to your registration email address.

THIRD PARTY ACCOUNT INFORMATION
Propeller collects your authorization to access third party accounts (e.g Gmail) (“Third Party Account Authorization”). You also grant Propeller a license to access and use your Third Party Account to provide the functionality of the Platform. Third Party Account Information is maintained permanently or until you contact Propeller via email at support@propellercrm.com requesting to delete it.

USAGE INFORMATION
Propeller may also use certain standard web measurement and tracking technologies such as “cookies,” web server logs, or other statistics programs to collect certain indirect and/or aggregate information as a result of your use of, and interaction with, the Platform (“Usage Information”). This data is anonymous and does not personally identify you. Your browser may have an option that allows you to accept cookies, reject cookies, or receive notification when a cookie is sent, but you should note that the use of such restrictive browser settings may limit your use of the Platform. In addition, we may utilize use web beacons (also known as “action tags” or “one pixel .gif files”) to recognize you when you visit the Platform. We do not use spy ware, adware or any other similarly intrusive software. We may also use other technology, called clear GIFs, to provide us with other important anonymous information, such as when an e-mail has been opened.

STORED INFORMATION AND USER DATA
The Platform access the information that you store on certain third party accounts (each a “Third Party Service”), (e.g. Gmail), including your emails, contacts, calendars, and other information (“Stored Information”) and makes a copy of your Stored Information that is stored on a server owned or operated by or on behalf of Propeller.

USE OF YOUR STORED INFORMATIONPropeller uses your Stored Information only for the purpose of providing you with the features and functionality of the Platform. Propeller does not share or disclose your Stored Information with any other party, except in the following ways: (a) if you use the Platform to send an email or meeting invite or otherwise share information, Propeller may transmit this Stored Information to the intended recipient as an automated conveyance solely at your direction; (b) in the event that Propeller uses any third party service providers to provide the infrastructure or system necessary to provide the Platform (e.g., a cloud storage provider) then such third party service provider may also have access to (and a copy of) your Stored Information; (c) to the registered owner of the third party account listed in the Third Party Account Registration where such owner is an employer. By using the Platform, you provide your express authorization, consent, and permission to the access, use, storage, and disclosure of your Stored Information as described in this paragraph.

DISCLOSURE AND SHARING OF YOUR INFORMATIONIn addition to the paragraph above describing how Propeller shares your Stored Information, you agree that Propeller may share some or all of the following information with its third party service providers for the purpose of analyzing your use of the Platform and improving the Platform and Propeller’s other products and services: your email address, the date, time, and method by which you registered for the Platform, your Usage Information, and general information about your interactions with the Platform (collectively, “Tracking Information”). Propeller will only share the minimum portion of your Tracking Information necessary to provide and improve the Platform.

Propeller may also disclose any information you provide or it collects including your Registration Information, Usage Information, Tracking Information, and Third Party Account Information, as required by law, such as to comply with a subpoena, or similar legal process, or when Propeller believes in good faith that disclosure is necessary to protect its rights, your safety or the safety of others, or to investigate fraud, or respond to a government request. You should be familiar with the privacy practices of all Third Party Services before providing your information. Propeller will not share your Stored Information unless expressly authorized by you or by a valid court order that has been issued in compliance with all applicable laws, including the Stored Communications Act. NOTE – IF YOU INTEGRATE THE PLATFORM WITH A THIRD PARTY ACCOUNT PROVIDED BY OR REGISTERED TO YOUR EMPLOYER, PROPELLER IS AUTHORIZED TO PROVIDE SUCH EMPLOYER WITH ACCESS TO ALL STORED INFORMATION COPIED FROM THAT SPECIFIC THIRD PARTY ACCOUNT. PROPELLER SHALL BE ENTITLED TO RELY UPON THE REGISTRATION INFORMATION PROVIDED IN CONNECTION WITH THE THIRD PARTY AUTHORIZATION FOR THAT ACCOUNT TO DETERMINE WHICH ENTITY OR PERSON IS THE REGISTERED OWNER OF SUCH THIRD PARTY ACCOUNT.

Finally, you agree that Propeller may transfer all information you provide, including your Registration Information, and Third Party Account Authorization, and Stored Information in the event of a sale, merger, dissolution, bankruptcy, corporate reformation or other corporate restructuring of Propeller, or in the event that Propeller sells, assigns, or transfers substantially all of its rights in the Platform. With respect to your Stored Information, Propeller will only transfer such Stored Information for the purpose of an assignee’s or successor’s continued provision of the Platform to you.

SECURITYPropeller takes commercially reasonable steps to help protect your information against loss, misuse and unauthorized access, or disclosure. However, you agree that by using the Platform to connect to a Third Party Service, you are choosing to transmit audio and/or images via such Third Party Service. You further agree that Propeller has no control over, and does not examine, review, access, record, or store, any communication transmitted by you or any other participant in a teleconference via a Third Party Service. You agree to defend, indemnify, release, discharge and hold harmless Propeller, its officers, directors, employees, affiliates and suppliers from and against any and all claims and demands including but not limited to, any claims for copyright infringement, defamation, invasion of privacy or right of publicity, arising out of or in connection with your use of the Platform to transmit such images and/or audio. PROPELLER EXPRESSLY DISCLAIMS ANY REPRESENTATION OR WARRANTY, WHETHER EXPRESS OR IMPLIED, WITH RESPECT TO ENSURING, GUARANTEEING OR OTHERWISE OFFERING ANY DEFINITIVE PROMISE OF SECURITY IN CONNECTION WITH YOUR INFORMATION.

YOUR CONSENTBy using the Platform, you are consenting to the use and processing of your information as set forth in these Terms, all of which activities will take place in the United States. If you reside outside the U.S. your information will be transferred to the U.S., and processed and stored there under U.S. privacy standards. By using the Platform and providing information to us, you consent to such transfer to, and processing in, the U.S.

CALIFORNIA USERS: YOUR CALIFORNIA PRIVACY RIGHTSCalifornia’s “Shine the Light” law, Civil Code section 1798.83, requires certain businesses to respond to requests from California customers asking about the businesses’ practices related to disclosing personal information to third parties for the third parties’ direct marketing purposes. Alternatively, such businesses may have in place a policy not to disclose personal information of customers to third parties for the third parties’ direct marketing purposes if the customer has exercised an option to opt-out of such information sharing. We have such a policy in place. You may opt-out of providing information to Propeller at any time by uninstalling the Platform and by emailing Propeller atsupport@propellercrm.com. In addition, if you wish to find out about any rights you may have under California Civil Code section 1798.83, you may notify us in writing at support@propellercrm.com. If you have opted-out as described above, and thereafter you elect to use our Platform this will requires us to contact you or share your information with the applicable Third Party Service, including Google, and your previous opt-out preferences will not apply to such sharing.
